The Problem If You submit a problem (“Problem”) to Prudent Juris for the purpose of seeking a solution (“Solution”) You will provide Prudent Juris with the details of the Problem and any documentation (collectively “Information”) relating to that Problem. You will include in the Information the intended result (“Result”) You want to achieve.  Prudent Juris shall in its sole discretion decide whether or not to accept the Problem for solving. The Quote After perusing the Information Prudent Juris will give You a quote (“Quote”) for providing a Solution and an estimate of the time it is expected to take to provide You with the Solution. Any variation to these terms and conditions contained in the Quote will take precedence over these terms and conditions.    3.    Deposit and Cancellation You may accept the Quote by written notice to Prudent Juris together with the payment of a deposit (“Deposit”) equal to 10% of the Quote.  If after 7 days of accepting the Quote You cancel your request for a Solution the Deposit is non-refundable. You agree that the amount of the Deposit is a pre-determination of the liquidated damages that would flow to us as a result of your cancellation of an Order.  4.   Payment Terms Prudent Juris’ credit terms (if not otherwise stated in the Quote) are strictly on receipt of the Solution.  Correspondence   All correspondence between You and Prudent Juris should be in writing by either email or facsimile. If there is any verbal communication between You and anyone on behalf of Prudent Juris it will be     confirmed in writing (“Confirmation”). If You do not dispute the contents of the Confirmation within 2 days of receipt You will be taken to have agreed that the Confirmation correctly reflects the verbal communication. Any amendment to the Quote and/or these Terms and conditions must be in writing to be of any effect.   6.  Return of Information Prudent Juris agrees to return the Information to You as soon as practical after whichever of the following events is appropriate: Prudent Juris decides not to accept the Problem for solving; You cancel your acceptance of the Quote; or Submission of the Solution.  7.  Confidentiality Prudent Juris undertakes not to disclose any of the Information (except as required by law) at any time except where that Information comes into the public domain. 8.  Guarantee In the event You implement the Solution and do not achieve the Result and You notify Prudent Juris no later than 30 days from the date on which the Solution is presented to You, Prudent Juris will refund all fees paid to it by You. Liability To the maximum extent permitted by law, we exclude completely all liability to any person for loss or damage of any kind (however caused, including by negligence) arising from or relating to your use of our services (“Services”). In the event liability cannot be excluded, such liability is to be limited in accordance with the Trade Practices Act 1974 (Cth).  10.
